What happens if I get a DOHMH C grade?

Short answer

You get a 30-day re-inspection window. You must post the C grade letter in your front window during the cure period (hiding it is a separate $1,000 fine). Re-inspection is your chance to improve to a B or A. Certain violations can trigger immediate closure regardless of grade.

The grading scale

DOHMH inspections are point-based. Lower points means fewer violations found:

The grade letter posting rule

This is strict and non-negotiable. The grade letter (whether A, B, or C) must be posted in a window or area clearly visible from outside the establishment, at eye level, at all times the business is open. Covering, removing, or failing to post the current grade is a $1,000 fine on its own, separate from any inspection violations.

You can post "Grade Pending" instead of a C if you formally request an OATH hearing and have the paperwork on file. Do not simply refuse to post.

Fine structure

Grade C / failure to re-inspect$600 to $1,000
Critical food safety violations (per violation)$300 to $2,000+
Grade letter not posted$1,000
Operating without a valid permit$1,000 per day
Imminent health hazard closure order$1,000+ and forced closure

Imminent health hazards

A separate category. Certain conditions (active pest infestation, sewage leaks, raw sewage back-up, loss of refrigeration, absence of hot water) can cause immediate closure regardless of point total. These result in a "Closed by Order of the Department" notice posted on the door and full re-inspection before reopening.
