The grading scale
DOHMH inspections are point-based. Lower points means fewer violations found:
- 0 to 13 points: A grade
- 14 to 27 points: B grade
- 28+ points: C grade
What happens the day of a C grade
- You receive the inspection report on-site with the point total and each violation.
- You are handed a C grade letter and a "Grade Pending" option.
- You have the right to request a hearing to contest, but during the cure period the grade letter must be posted.
- Re-inspection is scheduled within 30 days.
The grade letter posting rule
This is strict and non-negotiable. The grade letter (whether A, B, or C) must be posted in a window or area clearly visible from outside the establishment, at eye level, at all times the business is open. Covering, removing, or failing to post the current grade is a $1,000 fine on its own, separate from any inspection violations.
You can post "Grade Pending" instead of a C if you formally request an OATH hearing and have the paperwork on file. Do not simply refuse to post.

How to use the 30-day window effectively
- Read every violation on the report. Fix the exact condition cited, not just the general area.
- Set up temperature logs at every hot-hold and cold-hold station. Record readings every 2 to 4 hours.
- Book a pest control service visit in writing with a signed manifest you can show the re-inspector.
- Replace any damaged or missing handwashing soap, towels, and signage.
- Review the DOHMH penalty schedule (PDF) for each violation to anticipate costs.
Imminent health hazards
A separate category. Certain conditions (active pest infestation, sewage leaks, raw sewage back-up, loss of refrigeration, absence of hot water) can cause immediate closure regardless of point total. These result in a "Closed by Order of the Department" notice posted on the door and full re-inspection before reopening.
