Weekly Rundown · Week 26

September 28 to October 4, 2026

The biggest labor cost news of the year arrived October 1: New York's minimum wage will not rise on January 1, 2027, because a job-loss trigger in state law was met. The same day, Brooklyn North and Upper Manhattan opened their waste zone sign-up and Click to Cancel took effect. On-street container pilots expand to Brooklyn Community District 2 on October 15.

Minimum wage frozen at $17.00 for 2027 after jobs trigger

New York's minimum wage will not increase on January 1, 2027. The rate stays at $17.00 an hour in New York City, Long Island, and Westchester, and $16.00 in the rest of the state, because one of the "off-ramp" conditions in Labor Law § 652 has been met.

Reporting cites a six-month decline in seasonally adjusted statewide nonfarm employment, from more than 10 million jobs in January 2026 to 9.96 million in July. Under the 2023 law, inflation-indexed increases scheduled from 2027 on are skipped when certain economic conditions are triggered.

Governor Hochul announced on October 1 that she will propose changing the trigger to a percentage-based test. If the Legislature approves, the standard rate would rise to $17.60 in the NYC metro area and $16.55 elsewhere, effective March 1, 2027. Home care aide rates still rise January 1, to $20.00 in the NYC metro area.

Impact Budget 2027 labor at $17.00 for January and February, and model a $17.60 scenario from March in case the fix passes. For a business with 10 full-time minimum wage employees, the $0.60 difference is about $12,500 a year in wages on an annualized basis before payroll taxes. Tipped food service rates and the overtime exempt salary threshold are set separately, so confirm those with DOL before you set 2027 pay.

Brooklyn North and Upper Manhattan: the 60-day clock is running

The Phase 6 sign-up window opened October 1 and closes November 30. Full implementation is December 1. Businesses in both zones must sign a written agreement with one of the three authorized carters for their zone before then or be assigned.

Brooklyn North businesses in Williamsburg, Greenpoint, Bushwick, and Bed-Stuy, and Upper Manhattan businesses in Harlem, Washington Heights, and Inwood, are now on the same timeline Midtown South and Staten Island finished in August. The window includes Thanksgiving week, which shortens the useful time at the end.

Looking further ahead: Phase 7, Brooklyn East and Manhattan Northeast, opens January 1, 2027 with implementation March 1. Phase 8, Manhattan West and Queens West, opens April 1, 2027 with implementation June 1.

Impact Treat November 20 as your real deadline, given the holiday. Get three written quotes in October, sign in early November, and keep a signed copy on site. If you are in Phase 7 or 8, start tracking your volumes now.

Click to Cancel is in effect

New York City's Click to Cancel rule took effect October 1, making it the first U.S. city with a municipal rule of this kind. The FTC's 2024 nationwide rule was vacated by a federal appeals court in 2025, and the agency has not issued a replacement.

That means the city rule, not a federal one, sets the standard for any subscription sold to New York City consumers. The rule also bars businesses from charging customers to ship back items they received for free. The city estimates residents will save $21.5 million to $162.5 million a year.

Impact If you did not update your terms before October 1, do it this week. Enforcement starts with complaints, and the first complaints will come from customers who tried to cancel and could not.

On-street containers arrive in Brooklyn CD2 on October 15

DSNY's amended containerization rule sets October 15 as the implementation date for stationary on-street container pilots in Brooklyn Community District 2 and Manhattan Community District 9. The Manhattan pilot is extended through October 15, 2027.

In the pilot areas, large residential buildings (31 or more units) must use the on-street containers. Medium buildings (10 to 30 units) must use either the on-street containers, if approved, or rigid lidded bins from an authorized vendor. Buildings must keep lids clear of snow and ice, keep the surrounding area clean, give staff DSNY training materials and gloves, and keep bulk waste out of the containers.

Penalties: $100 for a first violation, $200 for a second within 12 months, and $300 for a third or later. Brooklyn CD2 covers Downtown Brooklyn, DUMBO, Brooklyn Heights, Fort Greene, and Clinton Hill.

Impact This is a residential rule, but it reaches mixed-use buildings with 10 or more apartments over ground-floor retail. Owners and supers in those areas should confirm which method DSNY assigned. Commercial tenants should keep their carter-collected waste separate from the residential containers to avoid summonses landing on the building.
